Alleged exposure and attorney admit

According to the suit, a PDF of messages from the court-ordered app OurFamilyWizard contained, on page 53, an unredacted intimate photo of the child and the child’s name appears over 70 times. The image was reportedly available for about 23 hours and could be downloaded without logging in. Moreno’s lawyers say Minc emailed that he had published a pre-redaction version and did not notice the error until roughly 23 hours later; the folder briefly went offline before being restored.

Claims and what Moreno seeks

Moreno pursues five claims including alleged violations of the federal law on nonconsensual disclosure of intimate images, invasion of privacy, negligence and civil conspiracy. She seeks statutory damages of $150,000 for each alleged disclosure or transfer, plus compensatory and punitive damages, attorney fees and an injunction barring further conduct.
